From the 81st Judicial District Court, Karnes County, Texas
Trial Court No. 3862-G
Honorable Donna S. Rayes, Judge Presiding
ORDER
On October 18, 2017, we received a motion filed by appointed attorney Richard Langlois requesting we rescind our order dated October 11, 2017.
The order dated October 11, 2017 addresses three motions: (1) appellant's pro se motion to designate Mr. McQuary as lead counsel, filed October 2, 2017; (2) appellant's notice of designation of lead counsel, filed by Mr. McQuary on October 3, 2017, which complied with Texas Rule of Appellate Procedure 6.1(c); and (3) the State's motion to abate this appeal for a determination of lead counsel and to which brief the State should reply. In response to the three motions, we denied appellant's pro se motion to designated counsel; acknowledged the properly filed designation of lead counsel; noted that Mr. McQuary is designated as lead counsel; and struck the appellate brief previously filed by Mr. Langlois, thus setting the brief filed by lead counsel Mr. McQuary as the brief to which the State should reply.
The Motion to Rescind Court's October 11, 2017 Order is DENIED.
