EX PARTE WAYNE DOLCEFINO, Applicant

ON APPLICATION FOR AN ORIGINAL WRIT OF HABEAS CORPUS CAUSE NO. 2316965 IN THE COUNTY CRIMINAL COURT AT LAW NO. 16 OF HARRIS COUNTY

Per curiam. ORDER

Applicant has filed an application for an original writ of habeas corpus pursuant to this Court's authority to issue extraordinary writs. TEX. CONST. art. V, § 5(c). Applicant alleges he was held in contempt of court and ordered to serve 180 days in the Harris County Jail, probated for six months, with three days in jail as a condition of probation.

He challenges the order finding him in contempt of court, and argues, among other things, that his video evidence refutes the court's direct contempt finding. The trial court's judgment of contempt and commitment order are stayed pending further action from this Court. Any parties who wish to respond to Applicant's habeas corpus claims shall submit their responses within 45 days of the date of this order. The motion for leave to file an application for a writ of habeas corpus will be held in abeyance until further order from this Court.

Applicant alleges he has filed a motion to dismiss his appeal pending in the Fourteenth Court of Appeals. If and when his appeal is dismissed, bail shall be set in the amount of $100 and the trial court is ordered to release Applicant from confinement upon the posting of bail pending this Court's resolution of this application and further order. Any sureties must be approved by the trial court. Filed: July 17, 2020
