Newell, J., filed a concurring and dissenting opinion in which Walker and McClure, JJ., joined.

While I agree with the Court's decision to reconsider its denial of relief on its own motion, I disagree with its decision to deny relief. I would remand the application for evidentiary development of Applicant's claims. Because the court does not, I respectfully dissent.
