ORDER ADOPTING MAGISTRATE JUDGE'S REPORT AND RECOMMENDATIONS
The above-styled matter is before the Court on the Report and Recommendation of Magistrate Judge F. Keith Ball concerning the respondents' Motion to Dismiss Pursuant to § 2244(d). On November 16, 2011, Judge Ball recommended that the motion be granted and, pursuant to Rule 72(b)(2) of the Federal Rules of Civil Procedure, commanded the parties to lodge any objections to his recommendation within 14 days. That period has expired, and neither party has voiced any objection.
