The order of the Superior Court that the plaintiff was held in lawful custody and not in violation of any of his statutory or constitutional rights is vacated. The case is remanded to the Superior Court for the entry of a judgment declaring that the violation of the plaintiff's due process rights resulted in his being unlawfully held in custody beyond the expiration date of his sentence, and for such further relief as may be consistent with the memorandum and order of the Appeals Court on file.
