ORDER

This case is currently set to be called at the session of the Court commencing on September 25, 2023, in Los Angeles, California. On August 31, 2023, the Commissioner filed a Motion to Dismiss for Lack of Prosecution. In response that Motion, the Court arranged and held a conference call with the parties. During the conference call, Mr. Etkins expressed an interest in working with counsel for the Commissioner to resolve his case. The Court set a follow-up call for September 21, 2023. During that follow-up call, Mr. Etkins informed the Court of the steps he had taken to gather information to support his case. The Court requested that he produce documents to the Commissioner and that, once he produced some documents, the Court would continue the case. Later that same day, Mr. Etkins confirmed that he produced documents to the Commissioner and the Commissioner confirmed receipt. We note as an aside that Mr. Etkins has relocated to Florida, so that a trial in Los Angeles, California would be difficult at this time. If the parties are unable to resolve this case by agreement, the Court anticipates changing the place of trial to Miami, Florida. In the meantime, it is
ORDERED that this case is stricken from the September 25, 2023, calendar in Los Angeles, California. It is further
ORDERED that this case is continued. Jurisdiction is retained by the undersigned. It is further
ORDERED that, by December 8, 2023, the parties shall file a joint status report or submit a proposed stipulated decision. In lieu of a joint status report, either party may file a separate status report stating that the other party has reviewed the report and agreed to its contents.
