ORDER ADOPTING AMENDED REPORT AND RECOMMENDATION

The Court, having reviewed the Amended Report and Recommendation of Magistrate Judge David W. Christel, objections to the Amended Report and Recommendation, if any, and the remaining record, does hereby find and ORDER:
(1) The Court adopts the Amended Report and Recommendation.
(2) The Amended Report and Recommendation is adopted and approved. Plaintiff's Application to Proceed In Forma Pauperis (Dkt. 1) is DENIED, Plaintiff's Proposed Complaint (Dkt. 1-1) is DISMISSED WITH PREJUDICE, and all pending motions, including the Emergency Motion for Declaratory Relief (Dkt. 2), is denied as moot.
(3) The Clerk is directed to send copies of this Order to Plaintiff, counsel for Defendants, and to the Hon. David W. Christel.
