THE COURT

ORDER MODIFYING OPINION AND DENYING REHEARING

It is ordered that the opinion filed December 3, 2007, be modified as follows:

(1) On page 3, the second sentence in the second paragraph is deleted. That sentence provides: “The hearing was noticed by the public administrator’s office.”

(2) On page 4, the second sentence in the third paragraph is deleted. That sentence provides: “Appellant indicated that the public administrator incorrectly noticed hearings before Commissioner Haupman.”

(3) On page 9, the third sentence in the last paragraph is deleted. That sentence provides: “These severe consequences demonstrate the need for care in properly noticing the hearing in the correct courtroom and properly ensuring the jurisdiction of the court where a commissioner hears a case.”

There is no change in judgment

Respondent’s petition for rehearing is denied.
