An appeal having been taken to this Court from an order of the Surrogate's Court, New York County, entered on or about February 02, 2022, which denied petitioner's application to vacate the probate decree, same court, dated May 17, 2021, And petitioner-appellant having moved, pro se, pursuant to CPLR 5704 and 6301: (1) to vacate the aforesaid probate decree dated May 17, 2021; (2) for a temporary restraining order and preliminary injunction; and (3) for leave to prosecute the appeal as a poor person, and for related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied in all respects.
