Estate of Jeanette Ottovich, Deceased, Randy Ottovich, Harvey Ottovich, and Karen Rayl, Executors Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Mark V. Holmes Judge

This case was on the Court's October 19, 2015 trial calendar for San Francisco, California. A fight about who should administer the estate delayed a resolution for years. Then the pandemic struck. But the parties did report earlier this year that the California Superior Court had appointed co-administrators. Real estate owned by the estate and on which the government has a lien will likely be sold, and respondent recently reported that a buyer has been found. As the case neared its second decade, the Court spoke with the parties on December 22, 2021. We learned that there has in fact been progress -- the Probate Court has approved the sale and the deal is currently in escrow. Petitioner's counsel says there'll be enough from the proceeds to pay the tax liability which would then make this case, at long last, moot.

It is therefore

ORDERED that on or before January 21, 2022 petitioner file another status report describing whether escrow has been concluded and the IRS paid.
