Opinion
Case No. 3D03-672.
Opinion filed November 26, 2003.
An appeal from the Circuit Court for Monroe County, Richard G. Payne, Judge, Lower Tribunal No. 99-309.
Greene, Smith; Paula Revene; Bonnie J. Helms, for appellants.
Gerald V. Walsh, for appellee.
Before COPE, SHEVIN and RAMIREZ, JJ.
The Estate of Royal B. Newman appeals a final judgment determining that the property settlement agreement between the decedent former husband, and the appellee former wife, retained its character as property settlement agreement subsequent to the parties' execution of an addendum to that agreement in 1992. We conclude that the trial court's findings, entered after an evidentiary hearing, are supported by the record and correctly characterize the agreement. See Salomon v. Salomon, 196 So.2d 111 (Fla. 1967); Karch v. Karch, 445 So.2d 1077 (Fla. 3d DCA 1984).
Affirmed.
NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DISPOSED OF.
