October 25, 2006.

Appeal from the Iowa District Court for Muscatine County, James E. Kelley, Judge.

The defendant appeals from the district court's judgment and order finding him civilly liable for wrongful death. AFFIRMED.

David Hering, Anamosa, pro se.

Robert Gallagher, Davenport, for appellee.

William B. Norton and Christopher L. Surls of William B. Norton Law Firm, P.C., Lowden, for appellee.

Esther Dean, Muscatine, guardian ad litem for children.

Considered by Vogel, P.J., and Miller and Eisenhauer, JJ.

David Hering appeals the district court's judgment and order following a bench trial finding him civilly liable for the wrongful death of his wife, Lisa. Hering raises several constitutional claims which are not meritorious due to the civil, and not criminal, nature of the case. Hering's remaining issues are not preserved for our review on appeal, as they were not raised at the district court. See Meier v. Senecaut, 641 N.W.2d 532, 537 (Iowa 2002). We affirm without opinion pursuant to Iowa Rule of Appellate Procedure 6.24(4).

AFFIRMED.
