On October 11, 2023, petitioner filed a Status Report. On October 11, 2023, petitioner also filed a Motion to Vacate the Court's October 4, 2023, Order. In his motion, petitioner requests that the Order served October 4, 2023, be vacated to permit petitioner to file his own Status Report, rather than the joint Status Report signed by respondent's counsel and petitioner's former counsel, filed September 29, 2023.
We will deny petitioner's above-described motion, as petitioner has filed his separate Status Report (see above) and the Court does not intend to strike that filing from the record in this case. The parties are reminded that the proceedings in this case are currently stayed and that, notwithstanding the stay of proceedings, Status Reports (preferably a joint report) concerning the then-current status of this case are due from the parties on or before March 13, 2024.
In view of the foregoing, it is ORDERED that petitioner's Motion to Vacate the Court's October 4, 2023, Order is denied.
