Defendant Clickbooth.com, LLC's Motion for Judgment on the Pleadings Based upon Patent Ineligibility Under 35 U.S.C. § 101 (" Motion") was heard before this Court on February 10, 2015 at 11:00 a.m., the Honorable James V. Selna presiding.
Having considered the Motion, all supporting and opposing papers, and oral arguments raised at the hearing,
THE COURT ORDERS AS FOLLOWS:
The Motion is granted without leave to amend. The complaint in this matter asserts claims based upon only U.S. Patent No. 6, 804, 660 (" the '660 patent"). All asserted claims of the '660 patent are invalid under 35 U.S.C. § 101 for failure to claim patent-eligible subject matter.
