ORDER

This case is currently calendared on the Court's Kansas City, Missouri trial session at Kansas City, Kansas, scheduled to begin October 21, 2024.

On July 9, 2024, the Commissioner filed a motion for summary judgment, which has been fully briefed by the parties. On September 20, 2024, the Commissioner filed a motion to withdraw his motion for summary judgment on the ground that the administrative record is incomplete. Along with the motion to withdraw, the Commissioner also filed a motion for continuance and motion to remand.

Upon due consideration and for cause, it is

ORDERED that, on or before October 7, 2024, Mr. Essay shall file an objection, if any, to the Commissioner motion to withdraw. It is further

ORDERED that, on or before October 7, 2024, Mr. Essay shall file an objection, if any, to the motion for continuance. It is further

ORDERED that, on or before October 7, 2024, Mr. Essay shall file an objection, if any, to the motion to remand.
