ORDER

Before the Court are the Findings, Conclusions and Recommendation of the United States Magistrate Judge, filed February 22, 2002; Petitioner's Objections thereto, filed March 11, 2002; Petitioner's Motion to Amend, filed March 5, 2002; and the Court's Order with respect to the Motion to Amend, filed March 8, 2002. In that Order the Court granted Espinoza until April 5, 2002, to file objections and any case authority responding to the Magistrate Judge's February 22, 2002 Recommendation.

Now before the Court is Petitioner's Amended Brief to 28 U.S.C. § 2255 Motion, filed April 10, 2002, which the Court treats as additional objections as provided for in the Court's March 12, 2002 Order.

The Court has reviewed these pleadings and is of the opinion that the Findings, Conclusions and Recommendation of the United States Magistrate Judge are correct, and they are ADOPTED as the Findings and Conclusions of the Court. Petitioner's Objections, including Petitioner's April 10, 2002 Amended Brief, are OVERRULED.

Judgement will be entered accordingly. SO ORDERED.
