Supreme Court of Florida
Aug 14, 2009
17 So. 3d 705 (Fla. 2009)

Opinion

No. SC09-602.

August 14, 2009.

Lower Tribunal No(s). 5D08-3126, 05-2007-CA-022974.

The petitioner filed a letter, which was treated as a petition for writ of habeas corpus.

To the extent the petitioner is seeking a review of the Fifth District Court's decision in Case No. 5D08-3126, this Court is without jurisdiction to consider the petition for writ of habeas corpus under any or all of the jurisdictional bases described in article V, section 3(b)( 3) and 3(b)(7)-(9), Florida Constitution. The petition is hereby dismissed. See Persaud v. State, 838 So. 2d 529 (Fla. 2003).

To the extent the petitioner is seeking relief from alleged unlawful confinement, the petition is hereby denied without prejudice to petitioner seeking subsequent relief in the proper court.

PARIENTE, LEWIS, CANADY, POLSTON, and LABARGA, JJ., concur.
