Order Per Curiam
This cause is before the Court on appellant Francisco Escobedo's fifth motion of extension of time to file his brief, of forty-five days until May 2020. Appellant's brief was due on March 31, 2020.
Appellant's brief was originally due on October 25, 2019. On January 24, 2020, the Court ordered appellant to file brief on March 6, 2020, and if the appellant failed to file his brief by that day, the case could be dismissed. Even so, appellant filed a fourth motion for extension of time until March 31, 2020, which was granted by this Court. In his fifth extension, appellant only states COVID-19 as the reason for extension.
The Court, having fully examined and considered appellant's fifth motion for extension of time to file the brief in this cause and the nature of the case, is of the opinion that, in the interest of justice, the motion for extension of time to file the brief should be granted in part and denied in part with order. The Court GRANTS IN PART appellant's fifth motion for extension of time and ORDERS appellant's brief to be filed in this cause on or before April 14, 2020. This Court instructs appellant that this Court will not grant any further extensions. Should appellant fail to file his brief on time, his appeal will be dismissed. See TEX. R. APP. P. 38.8(a)(1).
