Opinion

Nos. 72, 73, Docket 20338, 20339.

November 4, 1946.

Appeal from the United States District Court for the Southern District of New York.

From two interlocutory decrees in admiralty in consolidated cross-actions holding both parties jointly at fault for a collision which occurred in the Hudson River between the Steamship George E. Badger, an anchored vessel, and the Ferryboat Jamestown, off the Erie Railroad ferry slips at Jersey City, and providing for a division of damages to each vessel, the United States appeals; the Erie Railroad Company filing a cross-assignment of error in each case.

John F.X. McGohey, U.S. Atty., of New York City (Vincent A. Catoggio Jr., and John F. Quarto, Sp. Assts. to U.S. Atty., both of New York City, of counsel), for the United States, as owner of the George E. Badger.

Hagen Eidenbach, of New York City (Charles W. Hagen, of New York City, of counsel), for appellee Erie R. Co.

Before AUGUSTUS N. HAND, CHASE, and CLARK, Circuit Judges.

Decrees affirmed on opinion of COXE, Judge, 64 F. Supp. 946.
