ORDER
This is an appeal from a judgment signed September 15, 2015. The clerk's record was due November 16, 2016. The clerk responsible for preparing the record in this appeal informed the court appellant has not made arrangements to pay for the record. See Tex. R. App. P. 35.3(a)(2). No reporter's record was taken.
On November 23, 2015, the court notified the parties that it would dismiss this appeal for want of prosecution unless, by December 8, appellant made arrangements to pay for the clerk's record, see Tex. R. App. P. 37.3(b), and provided the court with proof of payment. No response has been filed, and the clerk's record has not been filed.
On December 28, 2015, appellant filed a motion for an extension of time to file his brief. Appellant's brief is not due until 30 days after the clerk's record is filed. See Tex. R. App. P. 38.6(a)(1). Accordingly, the court ORDERS as follows:
The court will dismiss this appeal for want of prosecution unless, within 15 days of the date of this order, appellant makes arrangements to pay for the clerk's record, see Tex. R. App. P. 37.3(b), and provides the court with proof of payment.
Appellant's motion for an extension to file his brief is DENIED AS PREMATURE.
