Dec 13, 1939
302 Ill. App. 502 (Ill. App. Ct. 1939)

Opinion

Gen. No. 40,715. (Abstract of Decision.)

Opinion filed December 13, 1939.

CONFESSION OF JUDGMENT, § 73execution of renewal note, sufficiency of evidence. Judgment confirming judgment by confession on note was proper, where sharply conflicting evidence showed that the controversy was a family dispute, that defendant had executed the judgment note as a renewal note for previous note in the same amount maturing about the same day, and that defendant subsequently tore his signature off the note, intending to destroy evidence of his obligation.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from Municipal Court of Chicago; Hon. LAMBERT K. HAYES, presiding. Affirmed. Heard in third division, first district, at June term, 1939; opinion filed December 13, 1939.

Isidore Brown, Albert Langeluttig and Abraham W. Brussell, for appellant; Abraham W. Brussell, of counsel; David I. Spark, for appellee.
