TABORICK EPHRIM, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 265th Judicial District Court Dallas County, Texas Trial Court Cause Nos. F22-41486, F22-41487, F22-41488

ORDER

DENNISE GARCIA, JUSTICE

The bill of costs in each of these appeals has not been filed. On January 24, 2024, we ordered the district clerk to file by February 8, 2024, in each case a supplemental clerk's record containing the bill of costs. When February 8, 2024, had passed and the bills of costs had not been filed, the Clerk made telephone calls to the trial court to obtain the bills of costs. On February 28, 2024 and March 8, 2024, the district clerk filed letter with this Court stating the district clerk's appellate desk had not received the documents. As of the date of this order, the bills of costs have not been filed.

Accordingly, the Court ORDERS the trial court to conduct a hearing on the record within TWENTY DAYS of the date of this order to determine why the bills of costs have not been filed and the date on which they will be filed. The court shall enter all necessary orders to obtain the filing of the bills of costs within TEN DAYS of the date of the hearing.

We ORDER the trial court to transmit a record of the proceedings, which shall include written findings and recommendations, to this Court within THIRTY DAYS of the date of this order.

We ORDER the court reporter for the hearing required by this order to file a reporter's record of the hearing within THIRTY DAYS of the date of this order.

This appeal is ABATED to allow the trial court to comply with the above order. The appeal shall be reinstated when the trial court's findings are received or at such other time as the Court deems proper.

We DIRECT the Clerk to send copies of this order to the Honorable Jennifer Bennett, Presiding Judge, 265th Judicial District Court; Felicia Pitre, Dallas County District Clerk; Georgina Ware, Official Court Reporter, 265th Judicial District Court; Christina O'Neil, Chief Judicial Staff Counsel for the Criminal District Courts, Dallas County; and counsel for all parties.
