TABORICK EPHRIM, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 265th Judicial District Court Dallas County, Texas Trial Court Cause Nos. F22-41486, F22-41487, F22-41488

ORDER

DENNISE GARCIA JUSTICE

Before us is appellant's motion to extend time to file his brief. In this motion, appellant points out that the clerk's record and reporter's record are incomplete. The clerk's record does not contain appellant's judicial confession. The reporter's record is missing two exhibits, a domestic violence risk evaluation prepared by Dr. Eagle and a CSCD report. It appears that the evaluation and report were given to the court reporter, Georgina Ware, during the punishment phase. See RR vol. 5, p. 150.

Appellant's motion for extension of time to file the brief is GRANTED. Additionally, we ORDER Felicia Pitre, Dallas County District Clerk, to file a supplemental clerk's record containing appellant's judicial confession or a written statement that the judicial confession has not been filed with the district clerk within FIFTEEN DAYS of the date of this order. Further, we ORDER the court reporter, Georgina Ware, to file a supplemental reporter's record containing the missing documents or a written statement that the documents are missing within FIFTEEN DAYS of the date of this order.

We ORDER appellant's brief filed no later than THIRTY DAYS after: (1) the district clerk files a supplemental record containing appellant's judicial confession or a written statement that the judicial confession has not been filed with the district clerk, and (2) the court reporter files a supplemental record containing the missing documents or a written statement that the documents are missing, or at such other time as the Court deems proper.

We DIRECT the Clerk to send copies of this order to Felicia Pitre, Dallas County District Clerk, Georgina Ware, court reporter in the 265th District Court in Dallas, and counsel for all parties
