Opinion

No. 90-1947.

May 7, 1991.

An Appeal from the Circuit Court of Dade County; Robert P. Kaye, Judge.

Steel Hector Davis and Jose I. Astigarraga, Miami, for appellants.

Richard J. Burton Associates and Richard J. Burton, Fort Lauderdale, Deborah Marks, Miami, for appellees Joseph Rubin and Luis Goldsmith.

Before SCHWARTZ, C.J., and BASKIN and GODERICH, JJ.

The plaintiffs below appeal the trial court's order dismissing two of the defendants, Luis Goldsmith and Joseph Rubin, for lack of prosecution. We reverse since a review of the record demonstrates that there has been record activity within the one-year period preceding the dismissal. See Fla.R.Civ.P. 1.420(e).

Reversed.
