JAMES CLINTON ENLOW v. SHELL INTERNATIONAL EXPLORATION & PRODUCTION, INC.


In Re: Shell International Exploration & Production, Inc. and Transocean Offshore Deepwater Drilling, Inc., applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 597037.

McDonald, J., dissents and would grant the writ, reversing the district court's judgment of June 30, 2014 which granted James Clinton Enlow's Motion for New Trial. The previous judgment issued by the district court on March 19, 2014, granting Shell International Exploration & Production, Inc. and Transocean Offshore Deepwater Drilling, Inc.'s Motion for Summary Judgment, and dismissing the plaintiff's claims with prejudice, would be reinstated. The defendants met their burden on the Motion for Summary Judgment and the plaintiff failed to provide factual support sufficient to establish that he would be able to satisfy his evidentiary burden of proof at trial. See La. Code Civ. P. art. 966(C)(2). COURT OF APPEAL, FIRST CIRCUIT /s/_________
