Before the Court is attorney Peter Ian Morgan's motion to withdraw as court-appointed counsel for appellant James Marcel English. Based on the Court's opinion of this date, we GRANT the motion and DIRECT the Clerk to remove Peter Ian Morgan as counsel for appellant. We STRIKE the brief filed by Peter Ian Morgan in this case.
We ORDER the trial court to appoint new counsel to represent appellant in this appeal and to transmit a supplemental clerk's record including the order appointing new counsel to this Court within FIFTEEN DAYS of the date of this order. Within THIRTY DAYS after the date of the appointment, new appellate counsel shall file a brief that either (1) presents arguable issues found in the record or (2) complies with Anders v. California, 386 U.S. 738 (1967), and its progeny.
We DIRECT the Clerk to send copies of this order to the Honorable J. Andrew Bench, Presiding Judge, 196th Judicial District Court of Hunt County; Peter Ian Morgan; the Hunt County District Attorney's Office; and appellant James Marcel English, S/O#81513, C/O Hunt County Jail, 2801 Stuart Street, Greenville, TX 75401.
We ABATE this appeal to allow the trial court to comply with this order. The appeal shall be reinstated when the order appointing the new counsel is received or the Court deems it appropriate to do so.
