Appeal from the 109 District Court of Winkler County, Texas (TC# 15,682-B) ORDER
Pending before the Court is an unopposed motion for extension of time to file the Appellant's brief and for clarification of the Court's August 2, 2017 order which consolidated four appeals for purposes of briefing and oral argument only (cause numbers 08-17-00145-CV, 08-14-00146-CV, 08-17-00147-CV and 08-17-00148-CV). The Court concludes that the motion should be GRANTED.
The Court did not intend to consolidate these four appeals into a single appeal or a single cause number. Consequently, the Court will issue an opinion and judgment in each case. Based on Appellants' representation that there are issues common to all cases, the Court will allow Jones Gill LLP to file one consolidated brief on behalf of Acme Energy Services, Inc. d/b/a Rig Movers Express, Acme Energy Services, Inc. d/b/a Big Dog Drillers, and Endeavor Energy Resources, L.P. in cause numbers 08-17-00145-CV, 08-17-00146-CV and 08-17-00148-CV. The consolidated brief must include all three cause numbers on the cover. Further, Johnston and Associates, P.C. is permitted to file a separate brief on behalf of Nova Mud, Inc. in cause number 08-17-00147-CV. The consolidated brief and the brief of Nova Mud, Inc. are due in this Court on or before February 13, 2018.
