ORDER


Upon consideration of the foregoing Consent Motion to Extend Certain Briefing Deadlines, it is hereby ordered as follows:

If the Court grants Empagran Class Plaintiffs' Motion for Preliminary Approval of Settlement (the Merck Settlement), Defendants shall file their opposition to Empagran Plaintiffs' Motion for Order Directing Non-Settling Defendants to Produce Customer Contact Information for the Purpose of Effectuating Notice to Settlement Class Members ("Motion for Production") no later than three business days after receiving notice of the Court's decision, and Plaintiffs may file their reply ten business days following service of Defendants' opposition.

If the Court denies Empagran Class Plaintiffs' Motion for Preliminary Approval of Settlement (the Merck Settlement), Defendants shall not be required to file an opposition to the Motion for Production.
