ORDER OF REINSTATEMENT AND NOTICE OF REGARDING REPORTER'S RECORD
Trial court: County Criminal Court at Law No 10 of Harris County
We are in receipt of transcripts of a two part hearing on indigence matters held by the trial court on March 31, 2014 and April 10, 2014. At the conclusion of the hearing, the trial court found appellant, Benedict Emesowum, was not indigent. This case is reinstated and placed on our active docket.
On May 2, 2014, Emesowum filed a "Motion to Review the Arbitrary Indigency Ruling by Trial Court," and on May 6, 2014 an "Amended Motion to Review the Arbitrary Indigency Ruling by Trial Court." The motions are DENIED.
Emesowum is not indigent. Further, the indigence hearing transcripts reveal Mr. Emesowum has waived previous offers to have a court appointed attorney represent him, both at trial and on appeal. There are many dangers and disadvantages to proceeding pro se, most notably a lack of knowledge and understanding regarding civil procedure, evidentiary rules, and appellate procedure. Emesowum is strongly encouraged to retain a lawyer if he wishes to pursue this appeal.
Payment arrangements have not been made for the court reporter's record. If arrangements are not made for payment of the reporter's record within 10 days of the date of this order, this case may be considered on issues or points that do not require a reporter's record. See TEX. R. APP. P. 38.8(b)(4).
The court reporter, Bonnie L. Rodriguez, is ORDERED to inform this Court, through the filing of an information sheet, as to whether or not arrangements have been made for payment within 12 days of the date of this order.
