Opinion

No. 05-10-00799-CR

Opinion issued February 25, 2011. DO NOT PUBLISH. Tex. R. App. P. 47

On Appeal from the Criminal District Court, Dallas County, Texas, Trial Court Cause No. F09-51532-H.

Before Justices MOSELEY, RICHTER, and LANG-MIERS.

MEMORANDUM OPINION

Derric James Elmore was convicted of aggravated robbery. On December 18, 2009, the judge sentenced appellant to twenty years' imprisonment. Appellant timely filed a motion for new trial; therefore, his notice of appeal was due by March 18, 2010. See Tex. R. App. P. 26.2(a)(2). Appellant filed a pro se notice of appeal on May 19, 2010. Appellant's untimely notice of appeal leaves us without jurisdiction over the appeal. See Slaton v. State, 981 S.W.2d 208, 210 (Tex. Crim. App. 1998) (per curiam). We dismiss the appeal for want of jurisdiction.
