Opinion

2002-02316

Argued March 11, 2003.

May 19, 2003.

In an action to recover damages for malicious prosecution, the plaintiff appeals from a judgment of the Supreme Court, Nassau County (Skelos, J.), entered February 8, 2002, which, upon a jury verdict in favor of the defendants and against him, dismissed the complaint.

Steven Cohn, P.C., Carle Place, N.Y. (Andrew M. Lauri of counsel), for appellant.

Rivkin Radler, LLP, Uniondale, N.Y. (Evan H. Krinick and Cheryl F. Korman of counsel), for respondent Town of Hempstead.

Ryan Brennan, LLP, Floral Park, N.Y. (John E. Ryan and John M. Donnelly of counsel), for respondent Daniel Davis.

Before: A. GAIL PRUDENTI, P.J., DAVID S. RITTER, SANDRA J. FEUERSTEIN, THOMAS A. ADAMS, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed, with one bill of costs.

Contrary to the plaintiff's contention, the trial court properly gave a charge on the element of initiation (see generally Rohman v. New York City Tr. Auth., 295 A.D.2d 333; Dudick v. Gulyas, 277 A.D.2d 686; Dempsey v. Mastro, 83 A.D.2d 725, 726, affd 56 N.Y.2d 665).

The plaintiff's remaining contentions are without merit.

PRUDENTI, P.J., RITTER, FEUERSTEIN and ADAMS, JJ., concur.
