ORDER ADOPTING REPORT AND RECOMMENDATION and DISMISSING PETITION FOR A WRIT OF HABEAS CORPUS FOR FAILURE TO RECEIVE AUTHORIZATION TO FILE A SUCCESSIVE PETITION


Came this day for consideration the Petition for a Writ of Habeas Corpus by a Person in State Custody filed by petitioner ELARGE ELLISON, JR. On November 1, 2002, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that petitioner's successive application for a writ of habeas corpus be dismissed for failure to obtain authorization from the United States Court of Appeals for the Fifth Circuit to file a successive petition. No objections to the Magistrate Judge's Report and Recommendation have been properly filed of record.

The undersigned United States District Judge has made an independent examination of the record in this case and has examined the Report and Recommendation of the Magistrate Judge. The District Judge is of the opinion the Magistrate Judge's Report and Recommendation should be, and hereby is, ADOPTED. Accordingly, the petition for a writ of habeas corpus filed by petitioner ELARGE ELLISON, JR. is DISMISSED for failure to obtain authorization from the Fifth Circuit to file a successive petition.

LET JUDGMENT BE ENTERED ACCORDINGLY.
