By Order of Dismissal for Lack of Jurisdiction entered October 23, 2023, this case was dismissed for lack of jurisdiction on the grounds that petitioner Phyllis J. Ellis failed to file an Amended Petition, as directed by the Court. On October 30, 2023, the Court received from petitioner and lodged an Amended Petition.

In view of the foregoing, it is

ORDERED that, on the Court's own motion, the above-referenced Order of Dismissal for Lack of Jurisdiction is vacated and set aside. It is further

ORDERED that the Amended Petition, lodged October 30, 2023, shall be filed as of the date of service of this Order. It is further

ORDERED that, on or before January 2, 2024, the Commissioner (respondent) shall file an Answer to Amended Petition.
