No. 10-04-00012-CV (Tex. App. Mar. 31, 2004)

Opinion

No. 10-04-00012-CV.

Opinion delivered and filed March 31, 2004.

Appeal from the County Court at Law McLennan County, Texas, Trial Court # 99-0761-CV1.

Appeal dismissed.

Mohamed Elkharsity, Arlington, TX, pro se.

William F. Brown, Attorney at Law, Waco, TX, for appellee/respondent.

Before Chief Justice GRAY, Justice VANCE, and Justice REYNA.

MEMORANDUM OPINION

Mohammed Elkharsity seeks to appeal an order denying a recusal motion. However, the order in question is not one which is reviewable by interlocutory appeal. See TEX. R. CIV. P. 18a(f); Thomas v. Walker, 860 S.W.2d 579, 581 (Tex. App.-Waco 1993, orig. proceeding). The Clerk of this Court notified the parties that the trial court had not signed an appealable order and that the appeal would be dismissed for want of jurisdiction if a response showing grounds for continuing the appeal was not filed within 10 days. Appellant has not filed a response which states a basis for this Court to exercise jurisdiction. Accordingly, the appeal is dismissed. See Tex.R.App.P. 42.3(a).
