ORDER


The motion of Sprint United/Management Co., incorrectly sued herein as Sprint PCS, to set aside the default judgment in this action on the grounds that (1) service was improper pursuant to Fed.R.Civ.P. 4(h), and (2) the default should be set aside pursuant to Fed.R.Civ.P. 55(c) is granted pursuant to Rule 55(c) for the reasons set forth in the able report and recommendation of Magistrate Judge Henry Pitman. Plaintiff's objections to the report and recommendation are overruled.

SO ORDERED.
