On order of the Court, the application for leave to appeal from the April 23, 1999 decision of the Court of Appeals is considered and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

The notice of withdrawal of Question I from the application is treated as a motion to withdraw Question I from the application and it is DENIED as moot.

Kelly, J., would grant leave to appeal.
