Judgment, Supreme Court, New York County, entered on January 18, 1971, unanimously modified, on the law, to vacate the judgment in favor of defendant Green and to direct an inquest against said defendant, and otherwise affirmed, without costs and without disbursements. The defendant Green defaulted and did not appear in the action. An inquest against him should have been allowed.
