Mar 30, 1989
540 So. 2d 260 (Fla. Dist. Ct. App. 1989)

Opinion

No. 88-1424.

March 30, 1989.

Appeal from the Circuit Court, Orange County, George N. Diamantis, J.

Seymour Benson, Orlando, for appellant.

No Appearance for appellee.

This is an appeal from a "Final Order Granting Defendant's Motion to Dismiss" and an "Amended Final Order Dismissing Complaint Without Prejudice." Both orders dismiss a complaint without prejudice to refile another. Neither order dismisses the case. Neither order is appealable. See Lawler v. Harris, 418 So.2d 1239 (Fla. 5th DCA 1982); Gries Investment Co. v. Chelton, 388 So.2d 1281 (Fla. 3d DCA 1980).

APPEAL DISMISSED.

SHARP, C.J., and GOSHORN, J., concur.
