Karen EICH, Appellant v. Evan PORRAS, Appellee

From the 285th Judicial District Court, Bexar County, Texas Trial Court No. 2021-CI-14945 Honorable Antonia Arteaga, Judge Presiding

ORDER

PER CURIAM.

On July 3, 2024, this court struck Appellee's brief and ordered him to submit an amended brief that complied with the rules if he wanted an appellee's brief to be considered after the case was submitted to a panel. This court warned Appellee that if a rule-compliant brief was not filed as ordered, the appeal would be set for submission without an appellee's brief.

On August 1, 2024, Appellee filed an amended brief. It was timely, but it did not comply with the rules as ordered. Specifically, the brief contained no citation to authority. See Tex. R. App. P. 38.1(i), 38.2(a)(1).

Accordingly, Appellee's amended brief is struck. The case has been set for submission to a panel and will be considered without an appellee's brief. See Tex. R. App. P. 38.9(a); York v. Cooper-York, No. 02-20-00356-CV, 2021 WL 2753527, at *1 (Tex. App.-Fort Worth July 1, 2021, pet. denied) (mem. op.).
