JACK CRAIG EFFEL, Appellant v. ROBERT G. ROSBERG, Appellee

On Appeal from the County Court at Law No. 5 Dallas County, Texas
Trial Court Cause No. CC-17-02662-E

ORDER

In his notice of appeal, appellant states that he is appealing the trial court's denial "on the record" of his special appearance. By letter dated December 4, 2018, the Court questioned its jurisdiction over this appeal as the clerk's record did not contain a signed order denying the special appearance. Appellant filed a response asking the Court for a "short abatement" to allow the trial court to sign an order on the his special appearance. Accordingly, we ABATE this appeal to allow the trial court an opportunity to sign a written order on appellant's special appearance. The appeal will be reinstated in TWENTY DAYS or when the Court receives a supplemental clerk's record containing the trial court's signed order, whichever occurs sooner.

We DIRECT the Clerk of this Court to send a copy of this order to the Honorable Mark Greenberg, Presiding Judge of County Court at Law No. 5, and all parties.
