ORDER OF DISMISSAL AND DECISION

This case is before the Court on respondent's Motion to Dismiss for Failure to Properly Prosecute, filed June 7, 2024, and heard on June 10, 2024, when the case was recalled from the calendar for trial during the San Francisco, California, trial session. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and argued in support of the motion.
Upon due consideration, and for cause appearing more fully in the transcript of the above-referenced proceedings, it is
ORDERED that petitioner's Motion to Dismiss, filed June 4, 2024, is denied. It is further
ORDERED that respondent's motion is granted, and this case is dismissed for failure to properly prosecute. It is further
ORDERED and DECIDED that for taxable year 2019, there is a deficiency in income tax due from petitioner in the amount of $76,793; for taxable year 2020, there is a deficiency in income tax due from petitioner in the amount of $39,929; and for taxable year 2021, there is a deficiency in income tax due from petitioner in the amount of $20,571.
