This case was called from the calendar of the Court's October 11, 2022, trial session for New York, New York. There was no appearance by or on behalf of petitioner. In a prior conference call with the Court petitioner requested a continuance because of his travel schedule. The Court indicated that petitioner should provide respondent's counsel with copies of his travel schedule. Petitioner also advised that if he was granted a continuance, he preferred a remote trial. Respondent appeared at the calendar call and presented evidence that petitioner was traveling for health reasons. Counsel for respondent did not object to petitioner's informal request for continuance.
Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED the parties shall, on or before November 30, 2022, file with the Court a status report(s) (joint or separate) as to the then-present status of this case. It is further
ORDERED that this case is continued to the Court's February 6, 2023, trial session commencing at 10:00 a.m., in Jacob K. Javits Federal Building, Room 206, 2nd Floor, 26 Federal Plaza, New York, New York 10278. It is further
ORDERED that, together with this Order, the Clerk of the Court shall serve on the parties copies of (1) the Notice Setting Case for Trial for the above referenced trial session; (2) the Standing Pretrial Order for Small Tax Cases for the above referenced trial session; and (3) the clinic letter(s) for New York, New York. It is further
ORDERED that jurisdiction of this case is retained by the undersigned and this Order constitutes official notice of its contents to the parties.
