The Court has determined that it should decline to accept jurisdiction in this case. See Ives v. State, No. SC08-2444, 2009 WL 1508441 (Fla. 2009) (table) (denying petition for review of Ives v. State, 993 So. 2d 117 (Fla. 4th DCA 2008)). The petition for discretionary review in this case is therefore denied. Petitioner's pending Motion to Accept Brief on Jurisdiction as Timely Filed is accordingly denied as moot.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d)(2).
