On order of the Court, the delayed application for leave to appeal from the May 11, 2001 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for plenary consideration of the claim that the Department of Corrections' deputy director no longer has the authority to overrule a warden's award of special good time credit under MCL 800.33. In deciding the question, the court shall consider the 1987 change in the statute effected by 1986 PA 322. The court shall also consider whether MCL 16.379, MCL 791.203 and MCL 791.205 may appropriately be read in pari materia with MCL 800.33 to support the exercise of higher management oversight authority regarding special good time credit. The motion to add issue is also considered, and it is DENIED.
