We affirm the trial court's orders dismissing the action against James Burgin. The complaint fails to state a cause of action against Burgin, individually, for violation of section 768.125, Florida Statutes (1989). See Ellis v. N.G.N. of Tampa, Inc., 586 So.2d 1042 (Fla. 1991); McDaniel v. Sheffield, 431 So.2d 230 (Fla. 1st DCA), review denied, 440 So.2d 352 (Fla. 1983).

Affirmed.
