Interlocutory judgment affirmed, with costs, with leave to the appellant to withdraw its demurrer and answer within twenty days, upon payment of the costs of the demurrer and of this appeal, upon authority of Whiting v. Elmira Industrial Association ( 45 App. Div. 349). All concurred.
