Respondent having moved to vacate the order of this Court entered February 13, 2013, which granted appellant permission to proceed as a poor person and assignment of counsel on the appeal taken herein from an order of the Family Court, Wayne County, entered in the Office of the Clerk of said Court on December 4, 2012,

Now, upon reading and filing the affidavit of Eric Easlick, sworn to February 16, 2013, the notice of motion with proof of service thereof, the affidavit of Jenny E. Easlick, sworn to February 27, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the order of this Court entered February 13, 2013, is vacated.
