JACKIE ALLEN EASLEY, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 86th Judicial District Court Kaufman County, Texas Trial Court Cause No. 21-11043-86-F

ORDER

AMANDA L. REICHEK JUSTICE

We REINSTATE this appeal.

Appellant's brief is overdue. Appellant's brief was originally due February 25, 2024. We abated this appeal on May 9, 2024, for the trial court to make findings and recommendations concerning appellant's brief. The trial court found that appellant is indigent and that appellant and his appellate counsel, Daniel Oliphant, have not abandoned the appeal. The trial court recommended granting Mr. Oliphant an extension of time to file the brief until August 2, 2024. We accept the trial court's recommendation.

We ORDER Mr. Oliphant to file appellant's brief on or before AUGUST 2, 2024. We caution Mr. Oliphant that if appellant's brief is not filed by that date, we may again abate the appeal for the trial court to make findings and recommendations concerning his failure to file the brief, or the Court may order Mr. Oliphant removed from representing appellant.
