Earle v. Hull

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1928
224 App. Div. 761 (N.Y. App. Div. 1928)

Opinion

June, 1928.

Judgment and order reversed upon the law and a new trial granted, costs to abide the event. We think that the question as to the ownership of the car should have been submitted to the jury. The plaintiff and her husband were interested witnesses and their credibility was a question for the jury. Lazansky, P.J., Young, Kapper, Seeger and Carswell, JJ., concur.
