ORDER
The motion to waive fees is GRANTED for this case only.
The application for leave to appeal is DENIED for lack of merit in the grounds presented.
Gleicher, C.J., would hold the application in abeyance pending further proceedings in the lower courts. Specifically, defendant's appeal was filed prematurely before a judgement had been entered, due to understandable confusion as to when that occurred. Assuming that defendant seeks re-issuance of the judgment in the district court, an appeal from whatever orders result from that motion may be pursued.
